Muniment of Title and Estate Administration

If someone dies and leaves a will, there are two options for transferring their property. One is muniment of title, which is a process that is unique to Texas. In this situation, no administrator or executor is necessary. The transfer of real estate titles is made without the need for creating a new deed.

For more complex estates, an administrator (or executor) is either appointed by the court or named in the deceased's will. The administrator will receive letters of testamentary from the court outlining their responsibilities.

An independent administrator is one named in the will or elected by all of the beneficiaries to serve as executor. Independent administrators do not need court approval to administer the estate.

Estate administrators fulfill the same duties the court would perform: collecting the assets, paying any debts and distributing the assets to heirs. There are a few additional legal requirements; we can help you with them.
